Privacy Policy

This Privacy Policy (this "Policy," this "Privacy Policy," or, where the context so requires, this "Notice") describes, explains, sets forth, and otherwise discloses the manner, means, methods, purposes, and circumstances in, by, and for which Decius (together with its parents, subsidiaries, affiliates, successors, assigns, officers, directors, employees, agents, contractors, licensors, and service providers, collectively, "Decius," the "Company," "we," "us," or "our") collects, receives, records, organizes, structures, stores, adapts, alters, retrieves, consults, uses, analyzes, aggregates, combines, discloses, transfers, makes available, aligns, restricts, erases, destroys, and otherwise processes information about you, whether that information identifies you directly, identifies you indirectly, could reasonably be linked to you, or does not identify you at all.
This Policy applies to the website located at deciusfit.com and every subdomain, predecessor domain (including, without limitation, gymvsn.com and any subdomain thereof), successor domain, mirror, and alias thereof; every gym page, member page, owner dashboard, QR-code landing page, sign-in page, forum, leaderboard, trainer chat, and other page or screen made available thereunder; every application programming interface ("API"), Model Context Protocol ("MCP") server, OAuth endpoint, webhook, and other programmatic interface we provide; every mobile application, progressive web application, and installable version of the foregoing; every email, text message, push notification, and other communication we send; and every other product, feature, tool, content, and service that links to or references this Policy (collectively, the "Services").
PLEASE READ THIS POLICY CAREFULLY, COMPLETELY, AND IN ITS ENTIRETY. BY ACCESSING, BROWSING, SCANNING A QR CODE THAT LEADS TO, REGISTERING FOR, SIGNING IN TO, CONNECTING AN AI TRAINER OR OTHER THIRD-PARTY APPLICATION TO, OR OTHERWISE USING ANY PART OF THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE COLLECTION, USE, DISCLOSURE, AND OTHER PROCESSING OF YOUR INFORMATION AS DESCRIBED IN THIS POLICY. IF YOU DO NOT AGREE WITH ANY PART OF THIS POLICY, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICES IMMEDIATELY.
This Policy is incorporated into, and forms an integral part of, our Terms and Conditions. Capitalized terms that are used but not defined in this Policy have the meanings given to them in the Terms and Conditions.
1. The Short Version
We understand that privacy policies are long. This one is longer than most, deliberately, because we would rather tell you too much than too little. Before the long version, here is the whole thing in three sentences, which are qualified in every respect by the remainder of this Policy:
- We do not sell your personal information. We do not rent it, and we do not trade it to data brokers in exchange for money.
- Other than that, we may use the information you give us and the information generated by your use of the Services for any lawful purpose whatsoever, including, without limitation, operating and improving the Services, building new products, training and improving artificial intelligence and machine learning models, research, analytics, advertising and marketing of our own products, and creating aggregated, de-identified, or derived data that we own outright and may use and share without restriction.
- The Services are provided as is, and our liability to you in connection with your information is limited to the fullest extent permitted by law, as described in Section 17 of this Policy and in the Terms and Conditions.
Nothing in this summary expands any right you have or narrows any right we have under the remainder of this Policy. In the event of any conflict between this summary and any other provision of this Policy, the other provision controls.
2. Definitions
For purposes of this Policy, and in addition to the terms defined elsewhere herein, the following terms have the following meanings, which apply equally to the singular and plural forms of the terms defined:
- "Personal Information" means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular natural person or household, and includes "personal data," "personally identifiable information," and any similar term as defined under applicable law, but excludes De-Identified Data and Aggregated Data.
- "De-Identified Data" means information that cannot reasonably be used to infer information about, or otherwise be linked to, an identified or identifiable natural person, including information from which direct identifiers have been removed, hashed, tokenized, generalized, or otherwise transformed.
- "Aggregated Data" means information about groups or categories of users, gyms, equipment, workouts, or activity, from which individual identities have been removed, including counts, averages, distributions, trends, rankings, heat maps, and statistical models.
- "Derived Data" means any data, insight, inference, score, ranking, prediction, embedding, vector, weight, parameter, model, or other output that we create, compute, infer, or generate from, using, or with reference to any information, including Personal Information, whether alone or in combination with other information.
- "Fitness Data" means information about your physical activity, training, exercise selection, sets, repetitions, loads, weights, durations, rest intervals, personal records, estimated one-repetition maximums, check-ins, attendance, streaks, rank, "aura," goals, programs, and any other information concerning your use of exercise equipment or your physical training.
- "Body Data" means information you choose to provide about your body, including body measurements, bodyweight, height, physique preferences, regional physique preferences, body-part targets, reported pain, discomfort, injuries, limitations, and any other information concerning your physical condition.
- "Location Data" means information about where you or your device is or has been, including precise geolocation derived from your device's GPS, Wi-Fi, or cellular signals when you permit it, approximate location inferred from your IP address, and the identity of the gym or gyms you select, visit, scan into, or check into.
- "User Content" means any text, photograph, image, video, audio, file, equipment list, equipment photograph, forum post, reply, comment, review, report, chat message, prompt, program, and other content or material that you submit, post, upload, transmit, or otherwise make available through the Services.
- "Connected Application" means any AI trainer, AI assistant, large language model client, chatbot, agent, or other third-party software or service that you authorize, via OAuth, a member key, an API key, an MCP connection, or otherwise, to access the Services or your information on your behalf.
- "Sell," "Sale," and "Selling" mean the disclosure of Personal Information by us to a third party in exchange for monetary consideration. For the avoidance of doubt, and to the fullest extent permitted by applicable law, none of the following is a Sale: a disclosure to a Service Provider; a disclosure you direct or authorize, including to a Connected Application or to your gym; a disclosure of De-Identified Data, Aggregated Data, or Derived Data; a disclosure in connection with a Corporate Transaction; or any disclosure described in Section 8 of this Policy.
- "Service Provider" means any person or entity that processes information on our behalf, including hosting, infrastructure, database, email delivery, payment processing, analytics, artificial intelligence, content delivery, customer support, security, and professional services providers.
- "Corporate Transaction" means any actual or proposed merger, acquisition, consolidation, reorganization, restructuring, divestiture, financing, sale of all or a portion of our assets or equity, bankruptcy, insolvency, receivership, or similar transaction or proceeding, and any due diligence in connection therewith.
- "Including" and "includes" mean "including, without limitation" and "includes, without limitation," respectively, whether or not so stated.
3. Scope and Applicability of This Policy
This Policy applies to all information collected by or on behalf of Decius through the Services, regardless of the device, browser, operating system, network, or Connected Application used to access them, and regardless of whether you are a gym member, a visitor, a prospective member, a gym owner, a gym operator, a gym employee, a field representative, a person who adds a gym to our map, a forum participant, a developer, or any other person.
This Policy does not apply to information collected by any third party, including any gym, gym owner, gym operator, Connected Application, payment processor, social network, or other website or service that you access through, or that links to or from, the Services. Each such third party has its own privacy practices, for which we are not responsible and over which we exercise no control. In particular, when you connect an AI trainer or other Connected Application to the Services, the information you direct us to share with it is thereafter governed by that application's terms and privacy policy, not this one.
This Policy does not apply to information that we process on behalf of a gym as that gym's service provider, to the extent applicable law designates us as such, in which case the gym's own privacy notice governs, and you should direct requests concerning that information to the gym.
Where the Services are made available through a gym, the gym may have access to certain of your information as described in Section 8. The gym's use of that information is governed by the gym's own policies and the gym's agreement with you, and not by this Policy.
4. Information You Provide to Us
We collect information that you provide to us directly, voluntarily, and knowingly, in any manner and through any channel, including when you create an account, complete a profile, scan a QR code, select a gym, add a gym to our map, log a workout, submit a measurement, report pain, post in a forum, send a message, chat with a trainer, connect a Connected Application, subscribe to a plan, contact us, or otherwise interact with the Services. The categories of such information include the following.
Account and identity information
- Your name, display name, handle, username, and any nickname you choose.
- Your email address, and any alternative email addresses you associate with your account.
- Your password, passcode, or other credential, which we store in hashed form, and the magic-link or one-time tokens we send you to sign in.
- Identifiers from any third-party identity provider you use to sign in, including the identifier, email address, name, and profile image that provider makes available to us.
- Your referral code, the referral code of anyone who invited you, and the fact that you were invited.
Membership and gym information
- The gym or gyms you select, join, follow, visit, scan into, or check into; your home gym; and the dates and times of each check-in.
- Invitations you send or receive, and the gym, program, or challenge to which each relates.
- If you are a gym owner, operator, or employee: your business name, business address, business contact information, role, the gym's equipment catalog, floor plan, photographs, hours, programs, and any other information you provide about your gym, as well as the information of any person you invite to administer it.
- If you add a gym to our map: the gym's name, address, equipment, photographs, and any other information you submit about it.
Fitness Data and Body Data
- Every workout you log, import, or complete, including each exercise, set, repetition, load, rest interval, duration, and note.
- Workouts you import from other applications, files, or services, including the full contents of any file you upload for that purpose.
- Your goals, preferences, preferred and avoided equipment, per-member equipment overrides, programs, program days, and exercise baselines.
- Body measurements, bodyweight, physique preferences, and body-part targets.
- Reports of pain, discomfort, injury, or limitation, including the body part concerned, severity, and any description you provide.
Body Data and certain Fitness Data may be regarded as sensitive, and in some jurisdictions as health information. You are never required to provide it. If you choose to provide it, you expressly consent to our processing it for the purposes described in this Policy, and you acknowledge that Decius is not a healthcare provider, a covered entity, or a business associate under the Health Insurance Portability and Accountability Act of 1996 or any similar law, and that such laws do not apply to the information you provide to us.
User Content and communications
- Forum posts, replies, reactions, "aves," follows, reports of other users or content, and any other community participation.
- Reports about equipment, including reports that equipment is missing, broken, moved, or mislabeled, and any photographs accompanying them.
- Photographs of equipment, gym floors, and anything else captured in such photographs, including other people, signage, and surroundings.
- Messages, prompts, questions, and instructions that you send to any trainer, assistant, or chatbot feature of the Services, and the responses generated to them.
- Correspondence with us, including support requests, feedback, survey responses, and requests to book a call or demonstration.
Payment information
If you purchase a subscription or any other paid feature, your payment card details are collected and processed directly by our third-party payment processor. We do not store your full payment card number. We do receive and retain information about your transactions, including the plan purchased, amounts, dates, currency, billing name, billing country and postal code, the last four digits and brand of your card, and the status of each payment, refund, and dispute.
5. Information We Collect Automatically
Whenever you access or use the Services, we, our Service Providers, and technologies embedded in the Services automatically collect certain information about you, your device, and your use of the Services, whether or not you have an account and whether or not you are signed in. That information includes the following.
- Device and connection information, including your IP address, browser type and version, operating system and version, device model, screen resolution, language and locale settings, time zone, and network or internet service provider.
- Usage information, including the pages and screens you view, the features you use, the buttons you tap, the searches you run, the links you follow, the referring and exit URLs, the date, time, and duration of each visit, and the sequence of your actions.
- Log information, including server logs, error logs, crash reports, request and response metadata, and performance diagnostics.
- Location Data, including approximate location inferred from your IP address, and, if and only if you grant permission through your browser or device, precise geolocation, which we use, among other things, to show you gyms near you.
- QR code and deep-link information, including which QR code, sticker, sheet, or link you scanned or followed, and when and where you did so.
- Session and authentication information, including session identifiers, member keys, OAuth authorization codes, access tokens, and refresh tokens, and the Connected Applications to which they were issued.
- Information stored in your browser, including in cookies, local storage, and session storage, such as your chosen gym, your referral code, your sign-in state, and interface preferences.
We use privacy-oriented analytics, cookies, local storage, and similar technologies for these purposes. Most browsers allow you to refuse or delete cookies and local storage, but if you do so, portions of the Services, including sign-in and gym selection, may not function. We do not currently respond to "Do Not Track" browser signals, because there is no uniform standard for recognizing or implementing them. To the extent required by applicable law, we will honor Global Privacy Control signals as a request to opt out of Sales and of sharing for cross-context behavioral advertising, noting that we do neither.
6. Information We Receive From Third Parties
We may receive information about you from third parties, and we may combine it with the information we collect from you and treat the combined information as described in this Policy. Such third parties include:
- Your gym, which may provide us with your name, email address, membership status, and other information in connection with inviting you to, or enrolling you in, the Services.
- Other users, who may mention you, invite you, refer you, follow you, report you, photograph equipment in which you appear, or otherwise provide information about you.
- Connected Applications, which may send us workouts, sets, programs, messages, and other information on your behalf when you authorize them to do so.
- Identity providers, payment processors, and email delivery providers, which provide us with authentication, transaction, and delivery information.
- Publicly available sources, including gym websites, business listings, maps, and equipment manufacturers' catalogs, from which we compile information about gyms and equipment.
7. How We Use Information
We may use all of the information described in this Policy, including Personal Information, for any purpose that is not prohibited by applicable law, including, without limitation, each of the following purposes, which are illustrative and not exhaustive, and none of which limits any other:
To provide and operate the Services
- To create, authenticate, maintain, secure, and administer your account.
- To show you your gym's equipment catalog, floor, and programs; to let you check in; and to record, display, and analyze your workouts, records, streaks, rank, and progress.
- To generate workout recommendations, sessions, programs, substitutions, and coaching, including recommendations that account for the equipment actually present at your gym and any Body Data you have provided.
- To make your information available to Connected Applications you authorize, in the manner and to the extent you authorize.
- To process payments, subscriptions, refunds, and referral rewards.
- To send you transactional communications, including sign-in links, receipts, security notices, and notices of changes to the Services, the Terms and Conditions, or this Policy.
To improve and develop products
- To understand how the Services are used, measure their performance, diagnose and fix problems, and conduct research, testing, and experiments.
- To develop new products, features, services, and business lines, whether or not related to the Services, and whether or not related to fitness.
- To build, compile, verify, and improve our equipment registry, gym registry, and catalog of gyms, equipment, and exercises, which we may make publicly available.
To train and improve artificial intelligence
We may use any information, including your Fitness Data, Body Data, User Content, trainer chat messages, prompts, and responses, and the photographs you upload, to train, fine-tune, evaluate, test, benchmark, and improve artificial intelligence and machine learning models, algorithms, and systems, whether our own or, in de-identified form, those developed with or for others. Such models, and their weights, parameters, and outputs, are Derived Data and are owned exclusively by Decius. Once information has been used to train a model, it may not be possible to remove its influence from that model, and deleting your account will not cause any model to be retrained.
To communicate and to market
- To send you newsletters, product announcements, tips, challenges, nudges, reminders, and promotional messages about Decius's own products and services, subject to your right to opt out of promotional email.
- To feature your public profile, public posts, rank, records, or achievements in leaderboards, forums, challenges, and share cards, where you have made them public.
To protect and to comply
- To detect, investigate, prevent, and respond to fraud, abuse, security incidents, spam, violations of the Terms and Conditions, and other harmful or unlawful activity.
- To comply with applicable laws, regulations, legal process, and requests from governmental authorities, and to establish, exercise, or defend legal claims.
- To enforce our agreements and protect the rights, property, and safety of Decius, our users, gyms, and the public.
For any other purpose
For any other purpose that we disclose to you at the time we collect the information, or for which you provide consent, and for any purpose that is compatible with any of the foregoing.
9. Ownership of Data and Licenses You Grant
As between you and Decius, you retain whatever ownership rights you have in the User Content you submit. However, by submitting it, you grant Decius the license described in the Terms and Conditions, which is worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable, to use, reproduce, modify, adapt, translate, create derivative works from, distribute, publicly display, publicly perform, and otherwise exploit such User Content, in any media now known or hereafter devised, for any purpose, including commercial purposes and the training of artificial intelligence, subject only to our commitment not to Sell your Personal Information.
All De-Identified Data, Aggregated Data, and Derived Data, together with all logs, usage information, metadata, registries, catalogs, statistics, models, and insights generated by or in connection with the Services, are and shall remain the sole and exclusive property of Decius, and you hereby assign to Decius any right, title, or interest you might otherwise have in them.
10. Artificial Intelligence Features
The Services include features powered by artificial intelligence, including trainer chat, workout and session generation, equipment extraction from photographs and documents, and equipment registry compilation. When you use these features, the content you provide, together with relevant context about you, your gym, your equipment, and your training history, is transmitted to one or more third-party artificial intelligence providers for processing, and the results are returned to us and to you.
Outputs generated by artificial intelligence may be inaccurate, incomplete, outdated, inappropriate, or unsafe. They are not medical advice, physical therapy, or professional coaching. You are solely responsible for evaluating any output before acting on it, and for any consequences of doing so. See the Terms and Conditions for further disclaimers.
We may review, by automated and human means, the inputs and outputs of artificial intelligence features for the purposes of safety, quality, abuse prevention, and improvement of the Services.
11. Data Retention
We retain information for as long as your account is active, for as long as necessary to provide the Services, and thereafter for as long as we have a legitimate business or legal reason to do so, which, for many categories of information, may be indefinitely. Factors we consider include the nature and sensitivity of the information, the purposes for which it is processed, the needs of our business, legal and regulatory requirements, and the resolution of disputes.
When you delete your account, we will delete or de-identify your Personal Information within a commercially reasonable period, except that we may retain: information we are required or permitted by law to retain; information necessary to resolve disputes, enforce agreements, or prevent fraud and abuse; information contained in backups, which is overwritten in the ordinary course; User Content you made public or shared with others, including copies held by other users, gyms, and Connected Applications; and all De-Identified Data, Aggregated Data, and Derived Data, which we may retain and use forever.
12. Data Security
We implement administrative, technical, and physical safeguards that we consider commercially reasonable and appropriate to the nature of the information, designed to protect information from unauthorized access, use, disclosure, alteration, and destruction. These include transport encryption, hashing of credentials, access controls, and restriction of administrative access.
HOWEVER, NO METHOD OF TRANSMISSION OVER THE INTERNET, AND NO METHOD OF ELECTRONIC STORAGE, IS ONE HUNDRED PERCENT SECURE. WE CANNOT AND DO NOT GUARANTEE THE ABSOLUTE SECURITY OF ANY INFORMATION, AND YOU PROVIDE INFORMATION AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE FOR THE CIRCUMVENTION OF ANY PRIVACY SETTINGS OR SECURITY MEASURES, OR FOR ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR INFORMATION BY ANY THIRD PARTY.
You are responsible for keeping your credentials, member keys, and access tokens confidential; for signing out of shared devices; and for promptly revoking access for any Connected Application you no longer use or trust. If you believe your account has been compromised, contact us immediately at privacy@decius.io. Where required by law, we will notify you of a breach affecting your Personal Information.
13. Your Choices and Controls
- Account information. You may review and update your profile and certain account information at any time in your settings.
- Your record. You may export your workout record in JSON or CSV format from your profile.
- Optional data. You may decline to provide Body Data, Location Data, and other optional information, and you may delete measurements and pain reports you have entered.
- Location. You may revoke precise location permission at any time in your browser or device settings.
- Connected Applications. You may revoke any Connected Application's access at any time.
- Promotional email. You may opt out of promotional email by following the unsubscribe instructions in any such email. You may not opt out of transactional or security communications while you maintain an account.
- Public content. You may delete forum posts and other public User Content, subject to Section 11 regarding copies retained by others.
- Account deletion. You may request deletion of your account by contacting us at privacy@decius.io.
14. Your Privacy Rights Under Applicable Law
Depending on where you live, and subject to the conditions, exceptions, and limitations of applicable law, you may have some or all of the following rights with respect to your Personal Information: the right to know or access the categories and specific pieces of Personal Information we hold about you; the right to correct inaccurate Personal Information; the right to delete Personal Information; the right to data portability; the right to opt out of Sales, targeted advertising, and certain profiling; the right to limit the use of sensitive Personal Information; the right to withdraw consent; the right to object to or restrict certain processing; and the right not to be discriminated against for exercising any of these rights.
To exercise any such right, email privacy@decius.io with the subject line "Privacy Request." We will need to verify your identity before responding, which may require you to confirm control of the email address associated with your account. You may designate an authorized agent to make a request on your behalf, subject to proof of authorization. If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Appeal," and, if you remain unsatisfied, you may contact your state attorney general or data protection authority.
California residents
In the preceding twelve months, we have collected the following categories of Personal Information as defined by the California Consumer Privacy Act, as amended: identifiers; customer records; commercial information; internet and other electronic network activity information; geolocation data; audio, electronic, and visual information (such as photographs you upload); inferences drawn to create a profile reflecting your preferences and characteristics; and sensitive personal information, including account credentials, precise geolocation (with permission), and health-related Body Data (if provided). We collect these categories from the sources, for the purposes, and disclose them to the categories of recipients described in Sections 4 through 8. We do not Sell or "share" (as that term is defined in the CCPA) Personal Information, and have not done so in the preceding twelve months. We do not use or disclose sensitive personal information for purposes other than those permitted by California Civil Code § 1798.121 and its regulations.
Residents of the European Economic Area, the United Kingdom, and Switzerland
Where the General Data Protection Regulation or a similar law applies, we process your Personal Information on the following legal bases: performance of our contract with you; our legitimate interests, including operating, securing, improving, and developing the Services and our business, which we have determined are not overridden by your interests or fundamental rights and freedoms; compliance with legal obligations; and your consent, including your explicit consent to the processing of any Body Data you choose to provide, which you may withdraw at any time without affecting the lawfulness of prior processing. You have the right to lodge a complaint with a supervisory authority.
15. International Data Transfers
Decius is based in the United States, and the Services are hosted in the United States. Your information will be transferred to, stored in, and processed in the United States and in any other country in which we or our Service Providers operate, which may have data protection laws different from, and less protective than, those of your country. By using the Services, you consent to such transfers. Where required, we rely on appropriate safeguards, such as standard contractual clauses, for such transfers.
16. Children's Privacy
The Services are not directed to, and are not intended for use by, children under the age of sixteen (16), or such higher age as is required by applicable law for a person to consent to the processing of their Personal Information without parental authorization. We do not knowingly collect Personal Information from such children. If we learn that we have done so, we will delete that information. If you believe a child has provided us with Personal Information, contact us at privacy@decius.io.
17. Limitation of Liability Relating to Your Information
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DECIUS, ITS AFFILIATES, OR ITS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO THE COLLECTION, USE, DISCLOSURE, STORAGE, LOSS, CORRUPTION, THEFT, UNAUTHORIZED ACCESS TO, OR OTHER PROCESSING OF YOUR INFORMATION, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY DAMAGES FOR LOSS OF PRIVACY, EMOTIONAL DISTRESS, IDENTITY THEFT, OR LOSS OF DATA, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT DECIUS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, DECIUS IS NOT RESPONSIBLE OR LIABLE FOR THE ACTS OR OMISSIONS OF ANY GYM, CONNECTED APPLICATION, ARTIFICIAL INTELLIGENCE PROVIDER, OTHER USER, OR OTHER THIRD PARTY WITH RESPECT TO YOUR INFORMATION, INCLUDING INFORMATION YOU DIRECTED US TO SHARE WITH THEM.
The limitations in this Section are in addition to, and not in lieu of, the limitations of liability in the Terms and Conditions, and shall apply to the maximum extent permitted by law.
